Tylenol Liver Failure Lawsuit

A Tylenol lawsuit related to liver failure has been filed in Puerto Rico. This lawsuit has been filed by a woman namely Michelle A

Gonzalez Soto and her family. Her husband Carlos Aguayo Porrata and other family members are other plaintiffs in this lawsuit. The lawsuit was filed on October 4 in the U.S. District Court for the District of Puerto Rico.

The product liability lawsuit has been filed against Johnson & Johnson accusing it for liver failure of the woman. It blames that the above said woman suffered from liver failure as a side effect of Extra Strength Tylenol.

The lawsuit states that due to the side effect of Extra Strength Tylenol, Soto had to suffer permanent injury. After suffering a liver failure she had to have a liver transplant. The lawsuit states that her liver damage was due to toxicity of acetaminophen, which is the main ingredient in Tylenol.

The lawsuit states that the woman used two tablets of Tylenol 500 Extra Strength. She took the medicine for mild headache before going to bed. She started vomiting, the very same night. Later she took other tablet next morning as she developed nausea and stomach pain. But she has to suffer nausea and stomach pain several days and she was taken to emergency room and was prescribed with two more Tylenol 500mg tablets.

About one week after she took the first dose of Tylenol, she went to the emergency room again due to yellowish and pale skin. She was shifted to Intensive Care Unit (ICU). Her condition deteriorated and ultimately she suffered from complete liver failure. She had to undergo a liver transplant to survive.

Her surgeons found symptoms of acute acetaminophen toxicity in her liver and attributed her liver failure to use of Tylenol. She will have to survive on medicines for whole life.

The lawsuit blames Johnson and Johnson for her condition. It blamed that the pharmaceutical company was aware of inherently dangerous effect of acetaminophen; the main ingredient of Tylenol, but it not provided enough warning or information to consumers about risks associated with this drug. It was aware of the risk of liver damage associated with acetaminophen, but it played by lives of many by not providing sufficient information about it.

Tylenol is an analgesic drug and is used for treatment of pain and fever. It acts as a pain reliever. It is used for treatment of different types of pain such as muscle pain, back pain, toothache, headache and pain due to arthritis. It is also used to treat cold and fever. It contains acetaminophen as main ingredient.

The family of Soto, blamed the pharmaceutical company to be negligent in recommending and advertising Extra Strength Tylenol, with acetaminophe
500 mg. It has given only a general warning on the drug’s label in very small print about the possible risk of liver damage from Tylenol. FDA had also suggested that acetaminophen overdose could lead to liver failure. FDA has asked for new warnings on drug label or other regulatory actions in June 2009.

In July 2011 Johnson & Johnson agreed to lower the maximum recommended daily dose. This action was targeted at minimizing liver damage risk associated with use of Tylenol. It also added stronger warnings about the potential risk of liver failure on drug’s label.

Soto and her family held Johnson & Johnson liable for her condition. They are asking for compensation for pain and suffering, medical expenses, loss of income, loss of consortium and other damages. They have asked for $31 million and an additional $75,000 a year for her medical care and expenses in future.
