One of the first things new businesses deal with is having their business name registered and approved by the concerned authorities, in one go. However, choosing a name for your company is not just about getting approval from the authorities at the time of business name registration; it is also about creating an impact on your target audience. Once you go through the process of business name registration, you are stuck with the name of your company. Therefore, there a lot of factors to consider when creating a business name. nA name that sticks nOne of the classic mistakes people often make is to name their company or their business on a certain variation of their name. This is a major mistake because of its lack of creativity. Using your own name may not produce the "punch" that can provide depth of protection from a trademark perspective. nCreating Credibility and Brand AssociationnFor new companies whose aim is to reach a very broad audience, branding is very important and common names will hurt them. These companies should be able to create a unique name that their audience can easily recognize. Having a unique name can also give you a stronger trademark rights and a good protection. nOriginalitynThis is the most basic factor you must take into consideration before registering your name. If your chosen name is already registered then you would automatically be rejected. Before registering your name, check your name’s availability online or by calling your state's incorporation office. (In the UK, this is the Companies House, and you can download the list of company name from their website).nSensitivitynBefore you can go through the process of business name registration, make sure that the name you have chosen does not contain any sensitive words or expressions. Restricted terms can be used in the name of your company only if you receive approval from the government or get a special license. nCorporate Law ConsiderationsnThere are laws that require businesses to state whether they are a "corporation," "company," or "incorporated" or use the abbreviation "corp.," "Inc.," or "Co". The purpose of this requirement is to clearly separate different entities from one another. Different state laws may vary slightly on the exact words that are required or permitted, though they generally have similar requirements. nIn addition, your corporate name may not (1) contain language stating or implying that the corporation is organized for a purpose other than that permitted by state corporation laws or the corporation's articles of incorporation; or (2) contain language stating or implying that the corporation is connected with a state or federal government agency or a corporation chartered under the laws of the United States. In the UK, there are strict laws that prohibit you from using any name that is substantially similar to a name that someone else is already using. nProtecting Your NamenEven if you incorporate under a name, it does not necessarily mean that you are protected from misuse of your company name. Incorporation means that no one else will be able to use the same name you are using. nThese are some of the considerations you have to take into account during business name registration. Of course, the registration of your business name is only the first step in a long line of events that ultimately leads to business incorporation. n
