I’ve helped many women through the highly emotional experience of marital breakdown. I’ve seen how their hard-earned money becomes the subject of a tug-of-war between the divorcing parties. I’ve had female clients tearfully say they wish they had planned better before getting married.

I’m all for romance and love but the reality is that divorce rates are climbing worldwide. In fact, marital break-up is at an all time high. How can you afford not to think about protecting yourself in the event of divorce?

It’s contrary to romance to think about divorcing your loved one as you’re walking down the aisle minutes away from saying I DO. You wouldn’t be getting married if divorce was on your mind.

Remove the emotion from your planning. We make wise planning so personal. Take a step back and get an objective perspective on what you need to do to minimize heartache and loss. We don’t want to think about it but, it does happen. Be prepared. You may never need it. If you do, you may be saving yourself tremendous heartache.

How do prenuptial agreements work? Are they a guaranteed, safe bet? The answer is NO. Not all prenuptial agreements are ironclad and guaranteed to stand up in court because they are subject to the scrutiny of the court.

While they’re legally binding, either party can try to have this agreement set aside. Common avenues to achieve this result are: lack of independent legal advice at the time of signing, lack of full financial disclosure at the time of the agreement and the presence of duress or coercion when signing the agreement.

Having said this, who should have a prenuptial agreement?
Generally speaking, everyone should unless the two people getting married have nothing. What the couple acquires after marriage is what gets divided up in the divorce settlement.

Talk to a lawyer to discuss what you should know before getting married and how this union affects your assets.
