When most people think of the divorce application process they think of something that is bitter and inundated with arguments between the spouses and their respective lawyers. Fortunately it does not have to be this way, but it requires the cooperation of both the lawyers and the couple. It is unnecessary to make the divorce a public forum for arguments and name-calling but unfortunately that is what happens most of the time. However, the best solution is to come to a mutual understanding and eventually an agreement that will appease both the husband and wife. One of the first questions that come to mind when someone thinks of agreements is giving up all rights to the marital property, but that is not necessary either. The answer you are seeking when working out an agreement is compromise, and compromise does not have to mean you walk away empty-handed. Unfortunately when a couple decides to divorce—or one makes the decision in most cases—the other party is intent on keeping certain specific marital property and is unwilling to budge in order to reach a reasonable agreement. Do not think this only happens when adultery is involved; it happens any time there is a disagreement over the dissolution of the marriage. Before you even separate it's a good idea to talk to a mediator or someone else who can help you work out the terms of our divorce before you fill out the divorce application. Some of the things you might be able to discuss include the following: · Primary custody of the children · Child support and spousal support/alimony · Visitation by the non-custodial parent · Distribution of cash assets such as bank accounts, investments and retirement funds · Assumption of joint debts including mortgages · Distribution of the marital residence: who will remain in the home and will one spouse retain the home or will it need to be sold? · In the case of a spouse that has always remained at home with the children, there may be the need to discuss financing for education in order for her to obtain gainful employment. · Who will carry health insurance for the children and/or the ex-spouse? The divorce application can provide for the person who has been carrying health insurance to continue to do so. Make no mistake about it: divorce is never easy on anyone, especially the children, but choosing to mutually agree on the terms of the divorce can the process proceed much smoother and maybe even allow the couple to at least walk away as friends so they can maintain a civil relationship. While some couples actually continue to participate in family gatherings together because of the children, this is not always possible as beneficial as it is for the children. Of course, it can also send mixed messages to the children, namely that there is a possibility their parents might reconcile at some point in the future. Choose the set up that is best for you and your children and at least maintain a civil relationship with your spouse.
