First of all, you need to acquaint yourself with the duties, which will befall your will's executor. They need to be mentally and physically up to cleaning out your home, organizing your possessions, keeping detailed records, and understanding the complex world of the probate process. You need to ask yourself if the people you are considering will be capable of the duties required of them. Then, you need to consider whether or not they will still be capable while grieving for you. The executor of wills presence of mind is very important as there will be items which must be done as quickly as possible following your death.
Second, you need to think about the executor of wills relationship with your family and other heirs. You should ask yourself whether or not they are able to stand up to family members who may challenge their authority. Consider whether the people you are choosing will be discreet and handle the situation well.
After you have decided on your first choice for your wills executor, you should ask them if they are willing to perform the duty. Most friends or family members consider it an honor to be asked and will say yes, but it is not a good idea for the knowledge that you named them your executor when they are also trying to cope with the grief from your death. It can also be a good idea to have a back up executor in mind in case they say no or to name as a back up in your will in case your original choice cannot perform the responsibilities for some reason. The executor of wills agreement ahead of time will make things move much more smoothly after your death.
