Attorney services cover a number of different services for attorneys and for the public. These services help public in filing an LLC in California and obtaining an apostille (a service which authenticates documents to be used in a foreign country). However, a key function for an attorney service is to do process service. This duty is to serve papers on those people who are summoned to appear in court. Process service is an interesting position, and one not only needs a clean record, but should also have an element of bravery about them. The process servers work part-time or full-time in serving legal documents. The U.S. Bureau of Labor Statistics (BLS) has reported that there are approximately 20,000 process servers within the United States. Some work for attorney services, some work for sheriff's offices and some are self-employed. Papers must be hand-delivered. Requirements for a Process Server are Different than a Clerk There are no actual formal educational requirements for a process server although they should have a high school diploma. Other requirements vary by state in which they operate. They must be 18 years of age or older and not have a felony conviction on their record. They must also pass a background check. A clerk would also need a high school diploma or equivalent, but no other requirements according to the state - only what would be required by the individual employer. They would not necessarily have contact with the public but would work at filing an LLC in California or filing other corporation documents for business owners. Of course, in many cases, a process server employed by an attorney service will also file legal documents in the courthouse. This often is an additional duty a server will take on. How Process Service Works The actions a process server takes in doing his job go generally in the following order: 1. He receives the assignmentrn2. He reviews his instructions, location, and other detailsrn3. He verifies the due date of the servicern4. He goes to the person's home or office to serve the papersrn5. He serves the person (legally he can "serve" the papers even if the person won't accept them)rn6. He records the time and date and location of service The documents served include complaints, subpoenas, restraining orders, summons or eviction notices. The most challenging part of the job is trying to locate those who are eluding the server. This is a little like a Colombo situation, that homicide detective on television some years ago. The server has to use surveillance in many cases, without alarming neighbors or the local police. In some situations, a process server can actually be put in danger on the job. For instance, one home had a vicious growling dog tied up in the front doorway. In another case, the person being served became angry and violent and held the server out the window threatening to drop him. This was an extreme case, but process servers must always be prepared.
