A logo will not be the official trademark of a company unless it is registered by the government of that state and trademarked as the official design of the company.
Here, I will be telling about how a company in United State can make its logo trademarking, so to use the ™ character in the logo design.
Original Logo design:
First you will need an original logo design that is made by your designer or a freelancer. But be sure to have all the stuff including, (AI files) of that logo. This is for surety that all the rights are reserved by your company and are subjugated to another company.
After that you will need to consult an employer of the United State Patent and Trade Mark office.
Design search:
You will need to consult the employ of the agency so that he can perform a design search for your company. This design search will help check if your logo is violating any other registered logo design and if no issues emerged your logo will be given a green signal.
United State Patent and Trademark Office for registered trademark symbol:
Once it is ensured that your logo is your own and is not taken from somewhere else. You will have to apply to the USPTO office for registered Trademark symbol status of your original logo design. The trademark must include a drawing of your logo to show how it will appear normally on a package.
After its trademarked you will be allowed to use your logo design with ™ sign.
Registering the Trademark ®:
Once the logo design of your company is trademarked, you can register your trademarking design using a ® with your registered trademark symbol. Normally, using a lawyer for this purpose will be a good idea.
One more thing, for registering your logo design you will have to provide a list of products that can use that symbol as the label and other required documents.
Finally, you will have to provide the image of your trademarking logo design so to get it checked how the logo design will appear in label format.
In brief, registering a logo design is considered better and more authentic because the ™ sign and ® registered sign provide a new life to the emblem design of any corporation.
