One man who has been awarded compensation for his suffering is Grzegorz Chylenski. The 33-year-old suffered facial injuries while conducting his duties at PG Components. He was operating a Computer Numerically controlled machine that had had one of its safety features disabled.
The safety mechanism, which prevented the machine from being operated with the doors open, had been deactivated in a bid to make it more efficient. However, this placed those who used the device at greater risk.
As Mr Chylenski reached into the open machine to retrieve a dropped component, he was struck on the head by moving parts, causing him to suffer a fractured jaw and cuts to his face and ear.
During a recent hearing at Cheltenham Magistrates' Court, the firm was fined £11,200 and ordered to pay £2,777 in costs, as well as compensation of £2,500.
Commenting on the case, Health and Safety Executive inspector Dominic Goacher said:
"The law clearly states that employers have a duty to ensure the health and safety of their employees, which includes ensuring machinery and systems of work are safe. In this instance, PG Components clearly failed to ensure the safety of Mr Chylenski, with unfortunate consequences.”
He added that the incident could have been avoided if the manufacturer’s safety feature had not been bypassed.
