Financial support after separation for de facto couples is very important issue that needs to be settled to lead a peaceful life ahead. This article will give you an overview of spousal maintenance. Also known as alimony, spousal maintenance refers to the payment which is payable by one partner to the other partner. It is often paid the spouse who earns more money than the other. The financial support can also be granted by the court when the applicant is unable to support himself or herself adequately because their earning capacity has been badly affected by separation. It can be given to the spouses who have physical or mental inability to get a gainful employment ahead. How the Court Considers Application for Spousal Maintenance While ordering financial support in de facto relationship, the court will consider many things in order to be sure that the applicant really deserves the maintenance. The judges will look into the income, property, financial resources, financial needs, responsibility of each partner to support the other, property settlement issues between the parties and child support needs to mention a few. Financial support for a child of de facto couples is determined by the same legislation as applies to the children of married couples. Orders of parenting arrangements for children are decided by the Family Law Act. Whether de facto or it is a marriage relationship, the court helps you to get the due financial support from your spouse. When can Spousal Maintenance in Defacto Relationship Be Sought? In a married relationship, financial support can be sought at any time prior to a divorce. But more commonly, applications for this are made after separation. Applications must be made within twelve months of the divorce orders coming into action. As far applications for spousal maintenance in de fact relationship, they must be made within two years of separation. In both cases, the court will consider factors which determine the value of alimony or support for the one of the spouses. The maintenance will be granted only in the situation where the spouse is not able to meet his/her financial requirements such as child education, household expenses because of the low income. The spousal Maintenance will last for the specific time decided by the court. However, it will automatically cease in the case of these events such as death of the recipient spouse, death of paying spouse or the remarriage of the recipient partner. If this type of situation occurs, it is the duty of the maintenance receiver to inform the paying spouse about the remarriage. And if the payments made after remarriage are discovered, they can be recovered from the recipient on the orders of the court.
