A deposition is a testimony given by a witness outside of court. Essentially, it is the act of giving sworn evidence. A deposition is usually conducted before a trial and without the presence of a judge to supervise the examination. Instead, the witness being deposed is put under oath. The purpose of a deposition is to develop background information and evidence prior to any legal proceedings. Having this information before a hearing can help lawyers better prepare their case for trial. The written record of a deposition is called an affidavit. This written record can be referenced during a hearing or trial to help determine the final outcome of the proceedings. The statements given in a deposition can later be used against the party who gave the deposition, or to reinforce evidence. They can even change the entire outcome of a trial!
