Medical malpractice claims are some of the most common in the legal world. There is much that can go wrong when a person is under the care of a doctor. They are also some of the most difficult to prove. People who have questions about medical malpractice should understand the process of filing the claim. A medical malpractice claim can truly take on a life of its own. It can develop in many different ways depending upon the validity and strength of the evidence. Understanding this life cycle is very important for those considering legal action or those defending against a malpractice claim.

Filing a medical malpractice claimr
The first step of the process is filing the claim. People should contact an atto
ey before taking this action. There are forms to fill out with the proper court. The claim must state certain things. It must also be filed in the right jurisdiction. It must identify the proper parties and make the right legal accusations. This is a very important part of the process. Improperly filed claims can be thrown out on technicalities, making it very difficult to go forward. This sets the tone for entire process.

Discovery and evidence collectionr
The next part of the process is arguably where the case is won or lost. You and your atto
ey will go through an evidence collection process. Discovery is the process of requesting documents from the other side. It also includes collecting statements from witnesses. Evidence can make or break a case from the very beginning. It is important to take care of any evidence that you might have. The atto
ey that you work with will stress the importance of collecting and preserving evidence in the right way. This process can take time and be very intensive. It is worth the time and cost if it leads to a successful case.

Potential settlement negotiationsr
The process can often go through advanced levels of negotiation. If you have a strong claim, then the other side might want to settle. They might make an offer to you to keep the case from going to trial. This is something that you and your atto
ey will nee to discuss. Settling the case makes sense in many instances. It can keep down the costs of litigation. It also gets the money into your hands more quickly. This is common in most cases, though it will not happen with all medical malpractice claims.

Heading to trialr
If the case does not settle, then you will go to trial. This process can last anywhere from a few days to a few weeks. The process can be tiring and stressful. Evidence is presented by both sides. At the end of the process, a jury determines who wins the case.
