The Role and Responsibilities of Property Conveyancing Lawyers
Conveyancing is a critical component in any property dealings, regardless of whether it is residential, commercial, or industrial real estate. Hence, conveyancing lawyers have a pivotal role to play at every stage of the process. A property conveyancer facilitates the transfer deal and settlement and ensures that in the transfer of title procedure, the client meets all statutory obligations and that his/her rights are protected. It is necessary for both the buyer and the seller to have a conveyancer on board as both have to fulfill certain conditions in the Contract of Sale and any deviation can lead to unwarranted litigation at a later date.
For this post, the role of a property conveyancer will be studied in detail from the perspective of both the buyer and seller separately.
Preparing Legal Documents
One of the fundamental responsibilities of a conveyancer is to draw up all the documents that form a part of the real estate transactions. A lot of caution has to be exercised here as any flaws in the contract can be detrimental to the interests of the seller or the buyer or both.
Seller – Two important documents are relevant to you as a seller. The first is the Contract of Sale that ensures that all conditions of the sale including any particular points are meticulously included in the document. This will safeguard you from any issues that might arise later. The other is the Vendor’s statement. A conveyancer will carry out the title and planning searches that will go into the final statement. The critical point here is that it shows that you have met all the disclosure obligations as per the relevant laws prevailing in your State or territory. Even though these are the two primary documents, your conveyancer may also be required to prepare supplementary documents that are important for the settlement process.
Buyer – Buyers too need a conveyancer to make sure that the title and full rights over the property is legally and rightfully transferred to them. Here too, the documents must be in line with the legal requirements for the transfer of property in that State or territory.
Offering Legal Advice

Seller – Your conveyancer will go through the Contract of Sale and advice you if any particular conditions have to be included too. Buyer
The bulk of legal advice to a buyer will be explaining the terms and conditions of the Contract of Sale. The buyer will be made aware of specific terms and conditions that are critical to the sale. The same goes for the Vendor’s Contract too. For instance, if there are any planning restrictions to subsequent expansion or renovation to the property or any other delicate points, the buyer should be made aware of these. These will be pointed out by the conveyancer. For these reasons, it is always recommended that the conveyancer goes through the contracts before the buyer signs it.
It is not the responsibility of the conveyancer to get involved in the financing arrangements, but the lawyers generally facilitate a settlement with the Bank. Just as property settlement lawyers often go out of their way to negotiate and resolve property disputes, so do conveyancing lawyers when dealing with their clients. They make sure that the Bank receives all the documents related to ownership of title well in time. They will also assist the buyer in preparing all the mortgage documents.
There is another boon for buyers. If any adjustments are needed before settlement, the conveyancer will ensure that you pay the costs linked to the property from the date of settlement only. You can, therefore, avoid paying such utility charges like water and electricity bills before the settlement date. You will also be helped to determine the statutory fees that have to be paid which depends on the cost of the property and the State where the property is located.
Arranging Final Details of Settlement
Finally, the conveyancer will take you through the final details of the settlement. For corporate entities, a commercial lawyer usually works in tandem with the conveyancer from this stage.
Seller – The conveyancer of the seller will coordinate with the buyer’s conveyancer to fix an ideal time for the settlement. The date of settlement is mentioned in the Contract of Sale and is decided in consultation with each other. This will depend on mutual convenience and the time given by the banks to complete their formalities.
After the settlement has been completed, the conveyancer will get in touch with the real estate agent of the buyer and advise handing over the keys of the property to the buyer.
Buyer – The buyer’s conveyancer will coordinate with the concerned parties and fix the ideal time for settlement. The bank will be contacted also to confirm if the funds are ready to pay the vendor, booking the settlement and providing the seller’s bank with all cheque details.
In case the buyer is directly making the payment, the conveyancer should be informed of the payment details at least a day in advance to give enough time to arrange the settlement. The seller’s real estate agent will then be contacted and directed to give the keys of the property to the buyer.
Real estate dealings are complex procedures, to say the least, and it is almost impossible for individual buyers and sellers to negotiate the tough legal challenges on their own. A property conveyancer should be hired if the deal is to sail through smoothly.
