USCIS Implementing Changes to U.S. Immigration Processing
Interviews for Employment Based Residency Applications
On August 28, 2017, USCIS announced that all adjustment of status applications based on employment will be scheduled for in-person interviews. With offices in New York City and Los angles, Wolfsdorf Rosenthal attorneys will be available to prepare and accompany applicants for these important interviews.
The purpose of in-person interviews, according to USCIS, is to provide the agency with the opportunity to determine applicant's credibility. USCIS' acting Director, James W. McCament, stated "This change reflects the Administration's commitment to upholding and strengthening the integrity of our nation's immigration system...."
There are concerns USCIS may not have sufficient trained staff to handle complex EB-1A, EB-2/3 or EB-5 cases. Our office has already received several interview notices for employment based adjustment of status applications. Many are concerned that this will increase the delay in processing. Adjustment applicants must thoroughly prepare for such interviews.
J-1 Visa Program to be Curtailed?
The Wall Street Journal reported on August 27, 2017, that the Trump Administration is eyeing "major reductions" for five of the popular employment-based cultural exchange visas in the J-1 visa program. These include the following J-1 exchange visitor programs:
• Au Pair
• Camp Counselor
• Intern/Trainee
• Summer Work Travelr
