Also, each party may seek information from the other information on the arguments that the other is going to raise in the court of trial for fault divorce, parenting and custody issues, even incidents of abuse and neglect. In legal terms it’s known as discovery process. Under discovery process questions are sent to the other party which has to be answered under oath and returned within a stipulated time. This process is known as interrogatory, similarly document requesting records and other relevant evidence is called document request. Depositions are part of discovery process. The person being deposed is known as, the deponent. The deponent or potential witness is put under oath and asked wide range of questions relevant to the case by the top divorce attorney of the other spouse. These questions by the attorney and the response by the deponent is noted down which if need be, can be used later on against the party who was deposed. Further, testimony at the deposition is likely to be cross examined with that of the party involved in case there is even slightest of difference in the answers. During trial if for any reason the deposed remains absent the deposition testimony that he provided earlier is taken into consideration.
