When does your employer owe you overtime pay.
There is no cap found in the FLSA on the number of hrs personnel aged 16 and older might work inside any workweek. The FLSA does not call for additional compensation or overtime pay for hours worked on Saturdays, Sundays, Holidays or common days of rest if those hrs do not exceed forty inside the same pay period.A workweek or pay period is outlined as 7 sequential 24 hr periods or 168 hrs. It needn't coincide with the calendar week, but may begin on any day and also at any hour through the day.Employers are not allowed to average hours over two or more weeks.Overtime pay gained in the specific workweek must be paid at the regular pay day for the pay period when the wages were earned.Your hourly pay shouldn't be less then the federal minimum wage, in case you are paid tips your hourly wage plus tips will have to be equal to or higher then federal minimum wage.Earnings could very well be established on a piece-rate, salary, commission, or various other basis, but in these kinds of cases the overtime pay due is required to be computed on the basis of the average hourly rate derived from such earnings. This is determined by dividing the total pay for work (with the exception of the legal ommissions noted above) in any workweek from the total amount of hours truly worked.Where an employee in a single workweek works at more than one different kinds of work for which unique straight-time rates have been established, the regular rate for that week is the calculated average of these rates.Basically all wages earned divided by total hrs worked would give your regular hourly wage.In addition, section 7(g)(2) of the The Fair Labor Standards Act allows, under particular conditions, the computation of overtime pay based on one and one-half times the hourly rate in effect when the overtime work is performed. The requirements for computing overtime pay pursuant to section 7(g)(2) are prescribed in 29 CFR 778.415 through 778.421. Where non-cash payments are made to employees in the form of goods or facilities, the reasonable cost to the employer or fair value of such goods or facilities must be included in the regular rate.
