When you can’t meet your Household Bills anymore, Maybe it’s time to File for Bankruptcy… It is sad to realize that in this economy that we have today, more and more homeowners are struggling to pay the mortgage on their homes. The stark reality is that the majority of homeowners now owe more than their home is worth. This creates an “upside down” effect. In other words, the home’s value has now sunk to a point where even if a person were to sell their home, they would likely lose more money than what the original purchase price was. This still makes the homeowner responsible for the balance left on the loan after it is sold. Sometimes, it is at this point, that people decide to file for bankruptcy to get out from under the debt that they have incurred. Filing for bankruptcy is probably one of the most emotional times in a person’s life that they will have to endure. Couple that with the reality that they may lose their home because of the downward spiral of the economy and the significant job losses can make for an incredible ‘perfect storm’ so to speak. No one person ever wants to file for bankruptcy. People want to pay their bills. People want to be responsible. People want to keep and maintain a high credit score, also known as a FICO score. This score helps to determine what kind of loan you will qualify for, if any and what interest rate you will wind up paying. The FICO score has the greatest impact on the decision-making process when you apply for a home loan. Because of this, most people work very hard to keep their credit score at a reasonable and acceptable rate. This allows for people to be extended credit by the banking industry. However, if your FICO score is low, it is usually because you have filed for bankruptcy, lost your home to foreclosure or had incurred an insurmountable medical debt. Sometimes the very best thing that people can do is to file for bankruptcy. This will allow a person to basically start their credit history all over again. However, in order to do that, you must have a very knowledgeable and informed bankruptcy attorney. Having a bankruptcy attorney will alleviate some of the stress that you will go through during the bankruptcy process. The attorney becomes your Power of Attorney which allows them to speak and act on your behalf during the process and also allows them to file papers on your behalf. This makes it so much easier on the person that has to file for bankruptcy. Regardless of where you live, whether it is in Rancho Cordova, Roseville, or even Stockton, you must use an attorney that is within the County in which you reside. Otherwise, the Court will not accept the filing. It is always in your best interest to find a knowledgeable, skilled attorney that is extremely familiar with the laws of bankruptcy and the laws that apply to your individual Counties to file the bankruptcy papers for you and to also speak on your behalf if you have to go to a Court hearing. The Power of Attorney allows your attorney to speak on your behalf during the entire bankruptcy process. When considering this and considering the attorney who will ultimately represent you during this process, it is important to note and keep in mind that the confidentiality is kept to a high standard. After all, this is your financial situation and future that you are dealing with and will be discussing with the attorney that you choose. After the completion of the bankruptcy process, it will take several years to re-build your credit and increase your FICO score. But, in time, this will be achieved, as long as you remain cognizant of the fact that you are re-building your credit worthiness from the ground up, so to speak. Always remember that you will get through this.
